By placing an order with Wish You Well you agree to be bound by the Terms and Conditions below.
Definitions:
“Wish You Well” is the company, which will supply the service and final film product.
The “client” is the end user who books Wish You Well's services for their event.
Services and products:
Wish You Well supplies a service on an event-by-event basis.
The Video Booth is a pod containing a screen and static camera that records up to 6 hours of footage at the event. Guests may approach the booth and their message will automatically be recorded; (the booth is not staffed). This is then edited and supplied to the client within 5 weeks of the event.
The Slow-mo Booth is an arrangement of filming equipment, backdrop and lights set up for Wish You Well staff to film guests performing in front of the camera. The footage is then edited and supplied as a slow-motion film to the client within 5 weeks of the event.
Wedding filming is the process whereby Wish You Well films a wedding event with one or more mobile cameras. The footage is then edited and provided to the client within 16 weeks of the event.
All products and services shown on Wish You Well's website are subject to availability. The images on the website are for illustrative purposes only and the actual product may vary slightly.
Booking:
Wish You Well requires a booking form to be completed via its website.
The client is solely responsible for providing accurate details when making a booking. All details stated on the booking form will be taken as given unless further notification is given in writing.
On receipt of the booking form and deposit Wish You Well will confirm the booking in writing.
Payment:
A non-refundable deposit of £200 is required to reserve a service. Wish You Well will invoice the client for the remaining balance which is payable no less than 30 days before the event. If the payment is not received by that date then Wish You Well reserves the right to cancel the booking.
Prices for products or services may be subject to change, but price changes will not affect any booking that has already been confirmed (unless additional services are subsequently requested).
Cancellation:
All cancellations must be made in writing.
Should the client cancel the booking the following charges will be applicable:

For cancellation more than 30 days before the event, the deposit is not refundable but the balance will not be charged.

For cancellation less than 30 days before the event, both deposit and balance are non-refundable.
Should Wish You Well need to cancel the booking it will fully refund to the client all monies paid.
There are no discounts or refunds if there is low usage of the booth at the event.
Venue access and location:
The client must provide Wish You Well with the full correct address and telephone number of the venue.
There must be suitable parking facilities at the venue for the duration of the booking, and reasonable access for both loading and unloading of equipment.
The Slow-mo Booth requires a space approximately 4x4 square metres to operate.
Wish You Well will deliver the Video Booth or equipment for the Slow-mo Booth to a suitable position agreed by both client and venue.
Whereas Wish You Well makes every effort to advise on the best available position for the booth, it is not responsible for any external visual or sound distortion, for example from disco or band sound or strobe lighting. Ideally the booth should be isolated from the disco. Wish You Well will not be held responsible for poor positioning of the booth if space is limited, or prescribed by the venue. Once the Video Booth has been placed in position, Wish You Well is not responsible if someone other than a Wish You Well employee moves the booth, interrupts the power supply or interferes in any way with the camera.
Wish You Well is responsible for:

Delivering and collecting the Video or Slow-mo Booths

Setting up the Video Booth in the agreed position and recording at the appropriate time

Setting up and staffing the Slow-mo Booth throughout the agreed time-slot

Retrieving data, editing footage and producing the final product
The client is responsible for:

Ensuring a constant mains electricity supply for the Video Booth and Slow-mo Booths

Ensuring the Video Booth is used properly and safely and is not moved by the client, guests or staff at the venue

Obtaining any copyright permissions or music or other materials used

Obtaining permission from guests to be recorded

The client will be deemed liable for any physical damage to the Video Booth or Slow-mo Booth, props and equipment that occurs during the event.
Footage:
Nudity and obscene gestures will be censored from the final edit but verbal content will not be edited. Wish You Well does not accept liability for any offensive action or language recorded during the event.
If the data is not recorded successfully due to equipment malfunction then Wish You Well will negotiate a partial refund of the booking fee. Wish You Well shall not be responsible for any further financial loss to the client due to unsuccessful recording.
Artistic licence:
Wish You Well uses professional expertise and discretion to ensure that significant parts of the event are recorded. Wish You Well cannot guarantee to record every aspect of the event as filming takes place 'live' and is therefore unpredictable. Wish You Well retains artistic licence. Wish You Well is not in control of the setting and this may lead to some images being in high shadow/contrast or partial/temporary obstruction of subjects being filmed or issues of low/mumbled/no sound. Wish You Well may be unable to take footage if the official stills photographer is not willing to allow filming when they are working.
Unless otherwise agreed, the client accepts Wish You Well’s decisions on creativity within the product or service. The client must state in writing within 7 days of receipt of the final edit of any faults or issues and Wish You Well will make every reasonable effort to rectify them.
Unforeseen lateness or non-attendance:
Wish You Well will make all reasonable efforts to prepare for the event and set up equipment on time, but it cannot be held responsible for lateness or non-attendance caused by circumstances outside its control such as traffic delays, severe weather conditions, unforeseen illness/incapacity, accident, technical, camera or equipment failure. In such circumstances, Wish You Well will contact the client wherever possible to discuss alternative arrangements.
Liability:
To the fullest extent permitted under law, Wish You Well accepts no obligation or liability (whether arising in contract, warranty, tort (including negligence), product liability or otherwise) for any incidental, indirect or consequential damages or liabilities arising with respect to the use of the booth.
The Video Booth and equipment supplied for the Slow-mo Booth and wedding filming remain the property of Wish You Well at all times.
Copyright:
Unless otherwise stated, Wish You Well retains copyright of all its original material. Original material includes video recordings, graphics, soundtracks, printed material and any other design or artwork commissioned by the client in relation to the booking. Distribution of any video content on the web is restricted to Wish You Well only. Video conversion, web streaming and other distribution of Wish You Well content by client or third parties is not permitted. The client is responsible for ensuring that permission is sought for the inclusion of any copyright material they supply to Wish You Well to enable them to deliver the product or service. The client must also ensure that permission is sought for any performers or performances, trademarks, locations and music. Music supplied by the client to Wish You Well to use in its production must be original and legitimately owned. Wish You Well accepts no responsibility for any breach in copyright for music supplied by the client. The client agrees to indemnify Wish You Well in the event of any breach of copyright claims being brought against them in respect of material supplied by the client.
Customer material:
Wish You Well retains the right to destroy all customer video material upon handover of the final product or service. Wish You Well accepts no liability for loss or damage of product or service once handed over to the customer. Wish You Well accepts no liability for loss or damage of customer personal property given to aid productions e.g. music CDs.

The Terms and Conditions on the website (www.wishyouwell.co.uk) plus the Booking Form and any subsequent amendments notified in writing form the entire agreement between the client and Wish You Well and supersede any oral communication or other representations. Wish You Well reserves the right to add or change these Terms and Conditions at its sole discretion at any time without prior notice.
